Article 1: Access rights
These conditions of sale are concluded on the one hand by SCI FORT DE TAMIE, Cooperative Society of Collective Interest with limited liability and variable capital, whose registered office is at GILLY SUR ISERE (Savoie), ZA de Terre Neuve II , registered with the RCS of CHAMBERY under the number 789 202 017 and on the other hand, by any natural or legal person wishing to make a purchase at the counter, or via the website of SCIC FORT DE TAMIE.
Participation in the acrobatic park implies acceptance by the customer of the rules of procedure displayed at the entrance to the site or on simple telephone request.
Access to the Fort de Tamié site is open to anyone in good moral and physical health. Practitioners will not be able to access the courses if they are under the influence of any substance whatsoever: medication, alcohol, drugs. All practitioners agree to be insured for civil liability.
Article 2: Purpose
These conditions of sale are intended to define the contractual relationship between SCIC FORT DE TAMIE and the buyer as well as the conditions applicable to any purchase made, at the counter or through the merchant site of SCIC FORT DE TAMIE, whether the buyer either professional or private.
The acquisition of a good or a service implies an unreserved acceptance by the buyer of these conditions of sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by SCIC FORT DE TAMIE.
SCIC FORT DE TAMIE reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Article 3: Exclusion rights
FORT DE TAMIÉ and its team reserve the right to exclude any person:
• Having a dangerous behavior for himself,
• Endangering the lives of others,
• Not respecting one of the points of the rules of procedure,
• Having accessed the facilities without having paid the financial compensation,
• Not respecting the general conditions of use.
The reservation allows the customer to be assured of availability on a time slot. If the client is late by more than 15 minutes, Fort de Tamié can no longer guarantee the availability of the time slot. The customer will then have to wait for the next availability. He cannot claim any refund.
Article 4: Rates
Prices are indicated per person and in euros. They include VAT. The price details indicate precisely the discounted price, depending on the age group and the number of participants. Only the prices in force at the time of registration will have a contractual nature, for the courses paid in advance and of the actual payment, for the courses paid in cash.
The customer is required to return the equipment made available to him (full harness – helmets). The customer being the sole judge of his ability to overcome the obstacles, no refund will be possible for a course started and then interrupted on his own initiative for any reason whatsoever.
To benefit from group rates, it is necessary to prepare a single payment for the group.
The individual rate applies to the customer who registers alone, or as part of a group of less than 10 participants.
The group rate applies to groups of more than 9 participants.
Article 5: Online purchases
The buyer, who wishes to buy a product or service must specify:
– His first and last name as well as his e-mail address
– The service(s) selected,
– The date of their realization
– The number of participants
To finalize the order, the consumer must read the GCS, accept them by ticking a box provided for this purpose, and proceed to payment according to the terms provided for in Article 6.
Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of its own conditions of purchase or other conditions.
All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will communicate by e-mail a confirmation of the order summarizing the purchases made, the price applied and the essential characteristics of the services ordered.
Using a discount code:

Article 6: Methods of payment
Payment is due in full for purchases at the counter and online.
This payment can be made on site either in cash, by check, credit card, holiday vouchers and on the internet only by credit card.
Payments made by credit card on the website will be made through the secure system which uses the SSL protocol so that the information transmitted is encrypted by software and that no third party can read it during transport on the network. The customer's bank account will be debited with the amount of the order, upon final validation of the transaction.
Payments made by check: The seller who has opted for this method of payment must present a valid identity document for any order at the counter.
Groups and communities:
At the customer's request, an estimate is drawn up and sent to the customer by email or by post. The total amount of the service is calculated according to the estimated volume of participants on the day of the service. The reservation option is maintained for a period of 30 days. In order to definitively reserve his service, the customer must send a deposit of 30%. In the event of cancellation of the service by the Customer, the reimbursement conditions are as follows:
- Full refund of the deposit if the cancellation occurs at least 7 calendar days before the event.
- No refund of the deposit paid if the cancellation occurs less than 7 calendar days before the event.
FORT DE TAMIÉ accepts payment by administrative mandate for public establishments. The balance is to be paid on the day of the service except for payments by administrative mandate.
Article 7: Cancellation, postponement and refund
The cancellation or modification of a registration by the SCIC FORT DE TAMIE essentially for reasons of impassable terrain or bad weather conditions, gives right to the postponement of the session to a later date, or to a full refund to the client.
Tickets sold at the counter or on the internet cannot be exchanged, resold or taken back. Any ticket purchased will not give rise to a refund, even if the ticket has not been used by the customer.
Article 8: Online sales and right of withdrawal
In accordance with article L.221-18 of the Consumer Code, for any remote purchase (by internet or by telephone) of an access ticket that is undated or valid for a determined period, the consumer benefits from a withdrawal period of fourteen (14) days from receipt of the Order confirmation email. Without prejudice to the foregoing and in accordance with the provisions of Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for the remote purchase of services "of accommodation services, transport , catering, leisure", ordered as a package or separately, for a date or at a determined frequency. Consequently, the consumer does not benefit from a withdrawal period for dated access tickets.
Article 9: Liability
SCIC FORT DE TAMIE is responsible for the proper performance of the Services ordered under the conditions laid down in these GCS. It is bound only by an obligation of means with regard to online sales, cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses and, in general, of any other fact expressly qualified by case law as a case of force majeure.
The SCIC FORT DE TAMIE cannot, under any circumstances, be held responsible in the event of loss, theft of access tickets, exchange vouchers or personal items of consumers who have not been the subject of a deposit in the place reserved for this purpose.
SCIC FORT DE TAMIE alone is authorized to determine the conditions of operation and maintenance of the tree climbing site, according to its needs and/or constraints and alone decides on the opening calendar and opening hours to the public; the services and attractions it offers as well as their conditions of use; the prices and terms of sale of the Services it offers to the public; the maintenance, repair, rehabilitation and renovation program for all or part of the equipment; the implementation of standards and rules concerning in particular the safety and health of people and property on the site.
SCIC FORT DE TAMIE may, at its sole discretion, decide to close public access to all or part of the site for as long as necessary, in particular for carrying out work necessary for the safety and protection of visitors, or related to the maintenance, repair, renovation, of all or part of the site's equipment or in the event of bad weather conditions or cases of force majeure forcing SCIC FORT DE TAMIE to close in whole or in part.

1. Definition of the activity:
Acrobatic courses at height are spaces for secure playful activity allowing practitioners to walk at height, independently and more or less acrobatically, on and between trees or other natural or non-natural supports. The activity is carried out with personal protective equipment such as climbing. Respect the trees by always staying on the marked paths so as not to bruise the roots of the trees by compacting the soil.
Autonomous practice of the activity:
This activity is autonomous within the meaning specified by the instruction of the Ministry of Youth and Sport n°07-103 JS of July 30, 2007.

2. Definition of the service provided:
The service provided includes, a right of access to the course, the supply and installation of the equipment of the practitioners, the description of the activity and the safety instructions and use of the equipment, the application on a test course for validation by an operator and monitoring, advice and/or any assistance during the session.
3. Right of access to the courses and entry to the site:
The entrance fee to the park gives access to the courses once. The fact of carrying out a course partially or not at all does not entitle you to any refund.
The site is also accessible free of charge to visitors who do not access the routes at height (visitors, family of practitioners, etc.), provided that they comply with all the clauses of these regulations.
4. Conditions of access to the routes at height:
To access the routes at height, you must:
- Be more than 3 years old!
- Have paid an entrance fee at the reception before accessing the facilities.
- Have benefited from the explanations of the safety instructions at the start of the session (briefing).
- Be in good health, and not be affected by any physical disorder (heart disorder, back, spine, dizziness, etc. The practice of the activity is strongly discouraged for pregnant women), nor psychological. The practice is prohibited for anyone who has consumed alcohol or any substance (narcotics or drugs) that may affect their abilities and/or alertness.
- Respect the conditions of age, size and support indicated in chapter 5 of these rules.
- Have previously taken out civil liability insurance.
- Have consulted the Safety and Rescue Organization Plan (identification of responsible persons, emergency telephone numbers, path to follow, etc.).
Smoking is prohibited on the activities.
The Management reserves the right to refuse access or to exclude any person whom it considers does not meet the aforementioned conditions.
5. Conditions of age, height, weight and accompaniment:
Access to the courses is not possible for people weighing more than 120 kg for reasons of material constraint; moreover, the supervision may limit access to certain routes below this weight depending on physical capacity or any other limiting factor. Pregnant women and children under 3 years old cannot do the acrobatic course activities.
For individuals, the accompaniment of children must be carried out as follows:

6. Security:
YOU PERFORM THE DIFFERENT COURSES IN AUTONOMOUS PRACTICE, YOU ARE RESPONSIBLE FOR YOUR OWN SAFETY.
Adopt responsible and prudent behavior in all circumstances.
• Clothing suitable for outdoor activities is strongly recommended:
For more ease, a sporty outfit is recommended. Plan jogging pants, sneakers or hiking shoes. Avoid shorts
sleeveless t-shirts and tie up long hair. Flip flops are prohibited.
The Fort de Tamié cannot be held responsible for soiling or damage to clothing and advises participants to favor non-fragile outfits that can get dirty.
The participant must take all measures to avoid any accident, and in particular tie his hair to avoid the risk of tearing in the pulley, empty his pockets (risk of falling objects), remove personal effects which may represent a danger during the activity (jewellery, bags, piercings, untied shoelaces, cameras, cameras, etc.). It is recommended to wear closed clothes.
• Security equipment :
Before departure, participants must be provided with personal protective equipment from the Fort de Tamié (harness, lanyards, pulley, helmet and headlamp for night courses). Only official Fort de Tamié equipment is authorized and compatible with the facilities. This equipment is subject to a systematic visual inspection before each use and periodic complete checks in accordance with the standards in force.
The practitioner keeps his equipment throughout the course and does not lend it to anyone. In the event of loss, the Fort de Tamié will ask the participant to reimburse the lost equipment (€200).
The various protective devices (against falls from a height, as well as shocks) are equipment whose purpose is to limit the consequences of falls or shocks. They do not make it possible to guarantee that the practitioner is systematically unscathed after possible shocks or falls (extract from the standard XPS 52-902). It is therefore forbidden to use unnecessarily or improperly the safety equipment in place (personal protective equipment, fall arrest, workshops, etc.).
Participants agree to respect the equipment (platforms, cables, panels, etc.). In the event of voluntary damage, the Fort de Tamié will invoice the damaged equipment at the purchase price.
• Safety instructions :
For practitioners only:
- Participants must attend the safety briefing (instructions). It makes it possible to show and put into practice safety rules and adaptation to equipment as well as to different kinds of workshops. They must also pass on one of the training courses (practice) to put these safety instructions into practice and test their abilities. Any person who, at the end of the briefing or the test course, does not feel capable, physically or morally, of correctly carrying out alone the manipulations essential to an evolution in self-insurance (in an autonomous way) must give up the activity. . The park staff reserves the right to refuse access to anyone who does not have sufficient physical or motor skills on these training courses.
- The participant is responsible for observing the safety instructions and must constantly personally ensure his movement in the trees while remaining permanently connected to the lifelines (marked in red).
- The participant must systematically read the signage of each workshop and scrupulously respect the instructions mentioned therein.
- Only one person at a time must go on a zip line. A maximum of 3 people can borrow the other workshops.
- It is forbidden to interrupt and/or leave a course before the end without the authorization and assistance of a facilitator.
- Participants resuming the activity, after a break, must have their personal protective equipment re-checked by one of the course leaders.
For all (practitioners and accompanying persons, walkers, etc.):
- In the event of a problem, please notify the park staff by any useful means. All staff have been trained to meet service and safety requirements.
- It is risky to walk under the workshops due to the possibility of falling objects (telephones, etc.).
- Always stay on the marked paths and read the signs provided for this purpose. It is strictly forbidden to cross the boundaries of the marked paths (cords, barriers, etc.), even to take a photo, in order to avoid any risk and to respect the trees and vegetation.
- It is forbidden to smoke in the forest.
- Dogs may be frightened or may frighten some people during the activity. They must be kept on a leash near areas frequented by participants.
• Weather situation :
The activity is possible even in rainy weather. However, in the event of severe weather (storm, thunderstorm, earthquake, etc.), if the activity turns out to be able to become dangerous, it must end as soon as the instructions given by those in charge. More generally, the Fort de Tamié staff reserves the right to interrupt all activities if it deems that the safety of participants is compromised. In this case, follow the instructions given by the park staff and do not detach yourself from the lifelines.
7 - Respect for the environment:
The forest is a fragile environment, the trampling of the ground degrades the vegetation AND KILLS THE TREES. Participants undertake to respect the environment (trees, fauna, flora) and to stay on the marked paths. It is therefore forbidden to pass beyond the barriers and ropes delimiting these paths, to uproot plants, to pick flowers...
8 - Opening hours:
Access is permitted only during park opening hours.
Access to the courses at height is strictly prohibited outside opening hours (unsecured and unsupervised installations).
9 - General:
Participants agree to practice the activity with courtesy and in a good mood.
10 - Insurance:
The Fort de Tamié takes out professional liability insurance. The entrance fee does not include insurance for practitioners, and in particular personal accident insurance.
This insurance allows you, in the event of an accident, to have compensation which varies according to the insurance companies.
Practitioners should therefore inform themselves in advance about their insurance conditions with their own insurance for the practice of an acrobatic park at height and, if they wish, take out specific individual accident insurance for this activity with of their insurers.
